Security information

CCTV operates in communal and public areas of our premises (including entry, reception, hallways, and the hot desk/co-working floor) for the safety and security of guests, staff, and property. CCTV does not operate in change rooms, inside the sauna or steam room, or in the massage room.

Marketing images

From time to time we may photograph or film on-site for marketing or social media purposes. We will seek your consent before capturing or publishing any image or footage in which you are identifiable — see section 7 below.

2. Sensitive (health) information

Health information is sensitive information under APP 3 and subject to a higher standard of protection. We collect it only to assess suitability for a service and keep you safe — never for marketing. Access is limited to staff and therapists directly involved in delivering your service, and to management where necessary for safety or incident handling. You must keep your health information up to date and tell us about any change before each visit.

3. How we collect your information

●      Directly from you: when you book, complete a health screening/waiver form, sign up to our mailing list, or contact us

●      Automatically: through our website, app, and booking platform (cookies, analytics)

●      Via CCTV: while you are on our premises

●      From third parties: our booking platform provider and, where applicable, payment processors — limited to what's needed to complete your transaction

4. How we use your information

●      To process bookings, payments, cancellations, and memberships

●      To assess contraindications and deliver services safely

●      To manage hot desk / co-working access

●      To communicate about your bookings and, where you've opted in, promotions and updates

●      To investigate incidents and maintain the safety and security of our premises

●      To improve our services and website

●      To meet legal, accounting, insurance, and regulatory obligations

5. Marketing communications

We will only send you direct marketing (email, SMS) if you have opted in, in line with the Spam Act 2003 (Cth). You can opt out at any time via the unsubscribe link or by contacting us. We do not use health information for marketing.

6. Cookies and tracking technologies

Our website and app use cookies to recognise returning visitors and improve your experience. You can disable cookies in your browser settings, though this may affect site functionality.

7. Photography and marketing images

We may photograph or film on our premises from time to time for marketing or social media purposes. We will seek your specific consent before capturing or publishing any photo or video in which you are identifiable, and you're free to decline. If you appear incidentally in the background of content you didn't consent to, contact us using the details below and we'll remove it.

8. Disclosure of personal information

We disclose personal information only where reasonably necessary, including to:

●      Our booking and payments platform provider

●      Staff and contracted therapists directly involved in providing your service

●      Professional advisers (accountants, lawyers, insurers)

●      Government or regulatory bodies where required by law

We do not sell personal information to third parties.

9. Overseas disclosure

We use Mindbody for bookings and Square for point-of-sale payments. Both are US-headquartered providers and store and process personal information on servers located in the United States.

We only disclose to overseas recipients where you've consented (including by making a booking or payment through these platforms), where we reasonably believe the recipient is subject to a law or binding scheme substantially similar to the APPs, or where disclosure is required by Australian law.

10. Information security

We take reasonable steps to protect personal information from misuse, loss, unauthorised access, or disclosure, including restricting access to authorised personnel, technological safeguards (e.g. firewalls), and physical security of our premises and records. No system is completely secure, and we cannot guarantee absolute security of information transmitted to us.

11. Data breaches

If we become aware of a data breach that is likely to result in serious harm to you, we will assess and respond in accordance with the Notifiable Data Breaches scheme under the Privacy Act, including notifying affected individuals and the Office of the Australian Information Commissioner (OAIC) where required.

12. Retention of personal information

We retain personal information only as long as reasonably necessary for the purpose it was collected, or as required by law, after which it is securely deleted or de-identified. As a guide:

●      Booking, payment, and financial records: retained for 7 years, in line with our tax and business record-keeping obligations.

●      Health screening and liability waiver records: retained for 7 years from your last visit, to allow us to respond to any claim within the applicable liability period.

●      CCTV footage: retained on a rolling basis for 14 days, except where footage relates to an incident, in which case it is retained separately for as long as reasonably necessary to resolve the matter.

●      Marketing/mailing list data: retained while you remain subscribed, and removed after 60 months of no engagement or upon unsubscribing.

13. Access and correction

You can request access to or correction of the personal information we hold about you by contacting us using the details below. We will usually respond within a reasonable period and may need to verify your identity first.

14. Age restriction

The Daily does not admit individuals under the age of 16 to any part of our premises, and we do not provide services to, or knowingly collect personal information from, individuals under 16. If we become aware that we have inadvertently collected personal information from someone under 16, we will take reasonable steps to delete it as soon as practicable.

15. Third-party links

Our website may link to third-party websites. We are not responsible for their privacy practices and encourage you to review their own policies.

16. Complaints

If you believe we've breached the APPs or mishandled your information, contact us first using the details below so we can investigate. If you're not satisfied with our response, you can lodge a complaint with the OAIC at oaic.gov.au.
